GradeAid Terms of Use
Version of October 21, 2026 · Jurisdiction: Quebec, Canada
These terms are drawn up in French; the French version prevails (clause 12).
1. Purpose
GradeAid is an AI-assisted grading tool for teachers. You provide a rubric (an answer key or a marking guide) and submit your students' work — typed answers, PDFs or photographs of handwriting. GradeAid transcribes the work, proposes a score per criterion against your rubric, and you review and adjust every result.
These terms govern access to and use of the service. By creating an account or using GradeAid, you accept them. They apply together with the Privacy Policy, which describes what information is processed, where it goes and how to exercise your rights.
2. Account
- One person, one account. An account is personal and in your name: it is used by one person and is not shared. A school or organisation that wants accounts for several people writes to us (clause 14).
- Accurate information. You provide an accurate name and email address and keep them current. The email address is used to sign in, to reset your password and to reach you for any notice under these terms.
- Password. You choose a password and keep it confidential. GradeAid stores only a hashed version of it, never the password itself. You tell us without delay about any unauthorised access to your account.
- Activation. During the beta, grading access is activated by the team after sign-up (clause 3). You can view your classes and grades in the meantime.
3. Beta program
- GradeAid is in beta. Teachers who sign up during the beta use it free, with no credit card, in exchange for their feedback.
- After sign-up, the team activates your access by hand; no card is requested. Your classes and grades stay available meanwhile.
- Every grading feature is available at no cost during the beta. In return we ask you to tell us what works and what gets in the way; your feedback directly shapes what we build next.
- End of the beta. We will tell you before the beta ends. You then pick a plan (clause 4), or stop there: your grades stay viewable and you can export your data (clause 11).
- We may end the beta program, or your participation in it, by written notice to your account's email address. Nothing commits you to continue after the beta.
4. Subscriptions, prices and cancellation
- Nothing is billed during the beta. The plans below apply after the beta.
- Advertised plans (plus applicable taxes):
- Elementary — CA$30 / month: AI grading for elementary classes (grade one to grade six).
- Secondary — CA$30 / month: AI grading for high-school classes (first to fifth secondary). This plan is advertised but not yet available for purchase; it will be offered as soon as the beta ends.
- Elementary + Secondary — CA$50 / month: AI grading for elementary and high-school classes (grade one to fifth secondary).
Everything is included in each plan; a subscription unlocks grading new work for the chosen level. Your existing classes and grades stay available either way, with or without a subscription.
- Monthly, no contract. The subscription renews each month. You cancel whenever you like and keep access through the end of the period already paid; no further period is billed.
- Changing plan. Upgrading from Elementary to Elementary + Secondary is prorated over the current period.
- Payment. Payments are processed by Stripe, on pages hosted by Stripe. GradeAid neither receives nor stores your full card details; we keep only a customer reference and your access status.
- Refunds. A started month is not refunded, except where applicable law requires it.
- Price changes. Any price change is announced to you in writing, at your account's email address, before it applies to your next renewal.
5. Student data and the teacher's responsibilities
- Roles. For the information about students that you enter or upload, you or your school are the controller: you decide which information to enter and why. GradeAid acts as a processor (service provider) and processes that information on your behalf, under your instructions, to provide grading. For your own account and payment information, GradeAid is the controller.
- Authority and lawful basis. You are responsible for holding the authority and the lawful basis to enter student information into GradeAid, including any consent, any authorisation from your school or school organisation and any notice required by your institution and by law. That information may concern minors; GradeAid collects nothing directly from students.
- Authorisation from your school organisation. The Ministère de l'Éducation's 2026 guide on artificial intelligence recommends that the use of such a tool for assessing student work be authorised by the school organisation. Check with your administration or your school organisation whether an authorisation is required before submitting student copies. We can provide the data-flow map for that purpose.
- Minimisation. You do not upload information beyond what grading requires. In particular, you do not enter sensitive information unrelated to the work being assessed, and you mask names whenever the task allows (for example on calibration copies).
- Where the data goes. For grading, the transcribed text of copies and photographs of copies are sent to Google Gemini, which processes them outside Canada and does not use this content to train its models; the database is located in Canada. The details, including the other providers and transfers outside Quebec, are in the Privacy Policy, which forms part of these terms.
- Schools and organisations. Where a school or school organisation is the controller, a separate processing agreement (contrat de mandat) sets out the instructions, security measures, sub-processors, retention and end of the mandate. In case of conflict, the signed processing agreement prevails over this clause for the information it covers.
- Requests from students and parents. Requests for access, correction or deletion concerning a specific student are addressed to the responsible teacher or school; GradeAid helps you answer them. Each student's page lets you permanently erase, in a single operation, everything GradeAid holds about that student.
6. Nature of the tool and professional judgment
- The tool proposes; you decide. GradeAid gives you a consistent first pass with a point-by-point breakdown. Every grade remains your professional judgment: you can change any score or comment, and your change always has the last word and replaces the proposed score.
- Outputs may contain errors. Handwriting transcription can misread a word; that is why GradeAid shows you the transcription to confirm before anything is graded. Scoring can be wrong; the tool is measured as generous on interpretation criteria (argumentation, structure) and accurate on calculation and language-correctness criteria. That known weakness is one of the reasons your review is indispensable.
- You are responsible for final grades. The grades, comments and documents you hand to students, parents or your institution are yours. GradeAid is an assistant, not a replacement for your judgment, and replaces no official document: the progress report always carries the note that it complements the official report card without replacing it.
- No automated decision about students. No grade is transmitted to a student, a parent or a school system without your intervention.
7. Acceptable use
You agree to:
- use GradeAid for grading school work and the teaching tasks that follow from it, within your role;
- not circumvent the service's technical limits (per-account and per-address rate limits, daily caps, access controls), and not access another person's account or data;
- not submit unlawful content, or content you have no right to process;
- not attempt to decompile, disassemble or reverse-engineer the service, extract the instructions given to the AI models, or copy parts of it to build a competing service;
- not automate access (bots, scraping) without our written agreement;
- not use the service to harm a student, a colleague or a third party.
In case of breach we may suspend or terminate access (clause 11).
8. Intellectual property
- Your content stays yours. You keep all rights in your rubrics, instructions, course material, comments and adjustments. You grant us only the licence needed to host, process and return them to you as part of the service.
- Outputs produced for you. Proposed scores, feedback, transcriptions, syntheses and documents generated from your content are for you; you may use, edit and hand them out in your teaching. GradeAid does not sell them and does not use them for advertising.
- No training on your content. GradeAid trains no AI model on your content or your students' work; the AI provider does not use this content to improve its models, under the terms of the paid tier we use.
- The service stays ours. GradeAid, its code, interface, starter rubrics, trademarks and documentation remain the property of GradeAid or its licensors. These terms transfer no right in them to you other than the right to use the service in accordance with these terms.
- Your feedback. Suggestions you make to us during the beta may be used freely to improve the service, without obligation to you.
9. Availability and changes to the service
- GradeAid is provided “as is” during the beta. We aim for a stable service, but we do not guarantee uninterrupted availability: maintenance windows, provider outages (hosting, AI model, payment) or incidents may occur.
- We may add, change, suspend or withdraw features, including preview features, with reasonable notice when the change reduces what you can do. Viewing your existing classes and grades is never withdrawn while your account exists.
- We may impose technical limits (requests per minute or per day, file sizes, page counts) to protect the service and control its costs; these limits are set reasonably and may change.
10. Limitation of liability
- To the extent permitted by applicable law, GradeAid is not liable for indirect damages, nor for losses arising from a grade, comment or document you handed out without reviewing it (clause 6).
- To the extent permitted by applicable law, GradeAid's total liability to you, for all claims related to the service over any twelve-month period, is limited to the amounts you paid for the service during that period.
- Nothing in these terms excludes or limits a liability that cannot be excluded or limited under applicable law, including the rights the Consumer Protection Act grants to a natural person.
11. Termination, export and deletion
- By you, at any time. You may stop using GradeAid, cancel a subscription (clause 4) and close your account. After a cancellation, your classes and grades stay viewable as long as the account exists.
- Export. On the « Mon compte » page, the « Télécharger mon archive » button produces a ZIP archive holding everything GradeAid keeps for your account — grades, student copies (text), per-criterion rationales, your adjustments, rubrics and their versions, classes and rosters, syntheses, report-card comments, course material (extracted text), generated assessments and grading preferences — in an open, documented format (one JSON file per table, a readable grade list, a manifest). Photographs of copies are not included: GradeAid does not keep them. The archive contains students' personal information; treat it as a grade book.
- Deletion. You can delete your account yourself from the « Mon compte » page (password and confirmation word; an active subscription must be cancelled first), or ask us in writing at the address in clause 14. The account and all data linked to it are removed from the active database within 30 days of a verified request, subject to the hosting provider's short-lived backups, which then expire. Payment records held by Stripe follow Stripe's policies and applicable financial record-keeping requirements.
- By GradeAid. We may suspend or terminate your access for a serious or repeated breach of these terms, after notifying you where circumstances allow. Even then, the export in clause 11.2 remains available to you for a reasonable period before any deletion.
- End of service. If GradeAid ceases operations or stops serving your account, your school or your organisation: 90 days' notice by email to each affected account's sign-in address; an export window for the whole notice period (the clause 11.2 button keeps working; failing that, we produce each account's archive and deliver it over an agreed channel); deletion of all data within 30 days after the notice period ends, followed by backup deletion on the hosting provider's cycle; written confirmation of deletion on request.
12. Governing law and language
- These terms are governed by the laws applicable in Quebec and the laws of Canada applicable therein. Any dispute is submitted to the competent courts of Quebec, without prejudice to any recourse the law grants you before another forum.
- Language. These terms are drawn up in French, in accordance with the Charter of the French Language. An English version is provided for convenience. In case of discrepancy, the French version prevails. You may ask that communications about your account be sent to you in French or in English.
13. Changes to these terms
We may change these terms as the product evolves. When a change is material, we update the version date above and notify account holders at their account's email address before it takes effect. If you do not accept a change, you may stop using the service and export your data (clause 11); continuing to use GradeAid after the effective date counts as acceptance.
